The Chemical Weapons (Prohibition) Act

The Chemical Weapons (Prohibition) Act (Chapter 37B) (CWPA) provides the legal framework for Singapore to meet its obligations under the Chemical Weapons Convention (CWC).

The Ministry of Foreign Affairs is the lead ministry of CWPA, and Singapore Customs has been designated as the National Authority to administer the Act.

The Chemical Weapons (Prohibition) Regulations 2007

The Chemical Weapons (Prohibition) Regulations 2007 (CWPR) provides detailed guidelines for administering the CWPA, including:

  • Conditions for licence approval

  • Exemptions for mixtures with low concentrations of certain chemicals

  • Submission of reports to the Director-General of Singapore Customs for activities involving scheduled chemicals

Here are What your company must do under Singapore law:

Obtain a CWC Licence before starting work with scheduled chemicals or unscheduled discrete organic chemicals (DOCs)

  • Required under Section 9 of the CWPA

  • Covers all activities involving scheduled chemicals or DOCs

Here are the activities that require a CWC licence.

Submit an Annual Declaration for Anticipated Activities

  • Required if you plan to produce, process, or consume Schedule 1, 2 or 3 chemicals

  • Governed by Section 12 of the CWPA and Regulation 10 of the CWPR 

Submit an Annual Declaration of Past Activities

  • Required if you have already conducted any controlled activities with scheduled chemicals or DOCs

  • Governed by Section 12 of the CWPA and Regulation 11 of the CWPR
